Karen Bobo (Mother of Victim)

Testimony Summary:

  • Holly graduated high school in 2009 and went to college for a year before transferring to a bridging nursing program.
  • Karen was teaching at an elementary school.
  • Clint was going to school part time, working at a nursing home, and studying to be a social worker.
  • Holly told Karen she had been up studying since 4:30 in the morning, while she was sitting on her bed.
  • When Karen left, she was sitting at the dining room table studying, after showering and changing.
  • Karen made Holly lunch and put it in the fridge and saw the $20 Dana had left her. She put the money in the wallet in her purse.
  • She said goodbye to Holly and left out the back door.
  • On the way to school, she spoke to Tina on her phone.
  • Holly called her while she was on the phone, and at some point, Karen and Holly spoke on the phone a few times about Drew having permission to turkey hunt on Karen’s mother’s land.
  • Karen called Drew and asked if everything was okay, then Karen called her mom, then Karen called Holly to tell her everything was okay.
  • The secretary told Karen her neighbor had called, reporting screams from the Bobo home.
  • She called Clint and asked what was going on. Clint asked if Holly had school today, and Karen said yes. Clint said he thought Holly was outside with Drew. She said, “That’s not Drew. Call all the neighbors.” Then, she called 9-1-1, but reached the wrong county line. Then she fell on the floor and called Clint, who was still asking whether Holly had school or if she was turkey hunting with Drew. Karen replied, “That’s not Drew. Get a gun and shoot him.” Clint replied, “You want me to shoot Drew?”.
  • A friend of Karen’s, Terry Brumley, drove her back to the residence. She called the police from her friend’s phone in the right county on the drive home.
  • Karen’s 9-1-1 call is played in court, and she begins crying.

  • Karen confirms Holly had an inhaler, before collapsing, stating she couldn’t breathe. The Judge called for a nurse, and the Jury was told to exit.
  • A mistrial is requested by Zach Adam’s defense team.
  • The Judge states this was a medical event due to low blood pressure and will therefore not give a new trial or jury. The defense also requests another day for cross-examination, which the Judge denies.
  • The Jury reenters, and the Judge tells them to disregard Karen’s panic attack/fainting.
  • The Judge begins joking with the Jury about his grandchildren.

  • Zach asked Clint to describe the suspect; when Clint described him, Zach said, “That was Shayne.”

·  Zach told them he could call someone from Karen’s phone and make it look like it was coming from someone else’s phone.[1]

·  She states she met with Shayne Austin on multiple occasions and knew his parents.

·  She also knew his parents and went to speak with them. Shayne’s parents told her that they had to move Shayne out because he would fill their home with drugs and people on drugs.

·  She spoke to Jason Autry as well at least twice. The first time was in August at a gas station, and the second was at his mother’s residence after his name kept coming up.

·  Karen states she initially spoke to Terry Dicus at least once a day.

·  Karen states Dicus told her he would have Holly home before multiple days.

·  Karen states she was at the mall when she heard they found human remains, and TBI agents came to the home later to tell them the remains were identified as Holly.

·  The Judge repeatedly says and implies that Jennifer Thompson does not know what hearsay is.

·  Karen confirms Janet Britt had previously worked at Joe’s Video, and she recognized the family because Karen taught her child in school. [2]

·  She states she taped a lot of the interviews she conducted, including her interview with Zach, which was turned over to the TBI.

[1] He was likely describing the spoofing card later referenced and explained in Rebecca Earp’s testimony.

[2] When asked about previously making a statement that Janet had “known Holly and Clint all their life,” Karen denies making the statement.

Clint Bobo (Brother of Victim)

Testimony Sunmary:

  • Clint is now a social worker.
  • He was attending UT Martin and working part-time.
  • He woke up the morning of Holly’s abduction to the sound of their dog barking.
  • He then went back to sleep.
  • The dog continuing to bark then woke him up again.
  • He got up to see what the dog was barking at.
  • He walked into the den and looked at the windows next to the front door (“sidelights”).
  • He didn’t see anything through those windows.
  • He then looked into the carport window and heard voices.
  • He slightly raised the blinds and saw the silhouettes of two people kneeling beneath the window.
  • He states it was dark in the carport.
  • He states it was a male and female voice.
  • He listened and recognized Holly’s voice, and assumed the male’s voice was Drew.
  • He was good friends with Drew, and they hung out regularly.
  • The male voice sounded aggravated, and the female voice sounded upset.
  • He listened to the voices for “seconds.”
  • The female voice was on the right, and the male voice was on the left.
  • He called Karen asking if Holly had school that day and did not reach her on the first call.
  • He texted her, “Call me ASAP,” and Karen called him back within 20 seconds.
  • While this is occurring, he is still listening to the voices.
  • He asked Karen if Holly had school since her car was still in the carport, and she said she had school that day.
  • He states he asked this because he thought maybe Holly was having car problems and someone was there to pick her up.
  • He told Karen Holly and Drew were in the garage, and Karen said, “That’s not Drew. Call all the neighbors.”
  • Then, Karen called Clint back. He states that at this point he could no longer hear the voices. He looked through the window again and saw Holly and a man walking into the woods.
  • He states he still thought the man walking into the woods was Drew, and he was wearing camouflage.
  • He states the man and Holly were “several feet” from where he was, but it was closer to the tree line.
  • TBI later had him identify where these people were standing.
  • He identifies a picture from the demonstration he did with TBI to show where Holly and the man were standing from his viewpoint.
  • The photo shows the people clearly visible through the window.
  • He thought it was a possibility they were going hunting together.
  • He states he began to realize the man’s size was “wider and heavier” than Drew.
  • He then thought the man was Richie, his cousin.
  • He states he did not see Holly and the man enter the woods.
  • He confirms a trail ahead of where they were walking leads to a logging road. Where they were walking was about eight steps to the trail leading to the logging road.
  • He states Karen called him again, telling him, “That’s not Drew. Get a gun and shoot him.”
  • He was still thinking the man was Drew or Richie, so he did not try to shoot him.
  • He went to the back door, opened it, and realized how cold it was.
  • He states he was confused and unsure.
  • He went and put on pants, socks, shoes, and got a jacket, gun, and his cell phone before leaving the back door.
  • He sees the pool of blood in the carport where the silhouettes were kneeling.
  • He’s thinking potentially Drew or Richie killed a turkey while turkey hunting.
  • He then crosses the deck and walks to the entrance of the trail leading to the logging road.
  • He stopped right before the tree line, and he didn’t see or hear anything.
  • He states it was unusually quiet, and he stood there for thirty seconds, before he saw Kathy Wise’s Ford pickup truck pull up in their driveway.

·  He parked, got out, and approached him, asking what’s going on, saying Ed heard screams up here a while ago.[1]

·  He then called 9-1-1.

·  He states when he first called 9-1-1, it went to Henderson County, and they transferred his call to Decatur County.

·  He states he told 9-1-1 that he thought his sister was missing.

·  He doesn’t remember telling them Holly went into the woods with Drew.

·  A police car pulled up and handed Clint a statement form to fill out with no writing utensil. He wrote it in the police car.

·  The second deputy arrived and spoke to Clint.

·  Karen and Terry Brumley arrived shortly after.

·  Karen grabbed him and shook him, asking why he didn’t do anything.

·  Policemen and people from the community arrived all day, and he was unable to continue writing his statement due to the number of people questioning him, so he got in the back of the police car to complete it.

·  Clint states he never previously knew Zach Adams, Shayne Austin, and Jason Autry.[2]

·  Clint states he knew of Dylan Adams.

·  He states the man was about 5’10” – 5’11” and weighed around 200 pounds.

·  He agrees this is not the same size or stature of Zach Adams and Jason Autry.

·  He states the height and weight of this person was the same as Shayne Austin.

·  He states the voice in the carport that he heard didn’t match the body of the man he saw.

·  He states he regrets not acting that morning; and, if he had had more information, he would’ve reacted differently and “we wouldn’t be here today.”

·  When asked about a statement he made that morning to Officer Viveros, stating he received a call at 7:30 am from Chad Marshall, he acknowledges he received a call, but could not remember the time, and stated he silenced the call and went back to sleep.

·  Around 7:40, he woke up to the dog barking.

·  He states he does not remember telling officers he had been awake for ten minutes before he heard the voices in the carport.

·  He states the female he saw in the carport had blonde hair.

·  He states both voices “sounded white,” and it sounded as though the man was giving orders to the female, who was agreeing.

·  Holly was wearing a pink t-shirt and blue jeans when walking into the woods.

·  He states after seeing the man walking into the woods, he still thought it was Drew.

·  He identifies the kind of camouflage the man was wearing as one someone may use if they were turkey hunting.

·  He states he thought he saw a deer grunt call in the man’s right hand.

·  He states this morning, for the first time in months, Clint parked his car in the garage, and the door was closed, making his truck not visible.

·  He states that, at this time, there were some days he left the house before Holly.

·  He told law enforcement the man had dark hair long enough to cover his neck under his cap. He described the man’s voice as “deep” and “low.”

·  He agrees he narrowed the voices down to two different samples – one of which was Terry Britt’s voice.

[1] Factually incorrect: Ed is Kathy Wise’s husband. James Barnes was the neighbor who heard screams.

[2] Jason Autry was is Clint's cousin, and Shayne Austin is related to Jason Autry. It is odd to claim he did not know them.

Dana Bobo (Second Testimony)

Testimony Summary:

·  He states that he and his cousin visited Shayne Austin’s trailer the Friday or Saturday after Holly’s abduction, and he saw a burn barrel.
