· She states that Zach would be “stern” and “threaten [her]” when she tried to leave.
· On the day before Holly went missing, she tried to break up with Zach.
· She knew Shayne Austin, and he was also involved in meth and morphine.
· She knew Jason Autry and Dylan Adams and states they all hung out with Zach regularly.
· The night before Holly’s abduction, he talked her into staying the night with him.
· She was woken up in the morning by Zach at around 6:00 – 7:30 am, who said he was hauling scrap.
· She states his demeanor was fine, and she went back to bed, before going to work at Joe’s Video.
· She states Zach was driving a white Nissan truck at the time.
· She states she knew Holly through Joe’s Video, because Holly used to tan there.
· She also knew Natalie Bobo through tanning at Joe’s Video.
· She saw Zach again that afternoon, when he stopped by Joe’s Video. They got into an argument because she thought he was lying about going to the scrap yard that morning, because he had used Dylan’s phone instead of his own.
· She states “he grabbed my head” before Jennifer Thompson objects.
· She states he was in the white Nissan pickup truck that afternoon.
· She states one night, she was making dinner, when the news of Holly’s abduction came on the TV. She states Shayne was smirking and started laughing, and Zach said, “They’ll never be able to find her.”
· She states Zach had “three parallel scratches on his neck” that were not present before he went scrapping, but she did not ask about them.
· After Holly was taken, she lived with Zach for three more months.
· She states Zach told her he would tie her up just like Holly Bobo and nobody would ever see her again.
· She moved out in July but continued talking to him afterwards and staying the night.
· She heard Zach talking to John Mitchell and saying that everything was ready to go in the back of the truck to put up under Birdsong Ridge, and said it was Holly’s remains in a blue Tupperware container. Later, John stated it was just the remnants of making meth, and it was a joke to see if she would call the TBI.
· She introduced Zach to Natalie Bobo.
· Zach had a Facebook account he used regularly.
· She states she reviewed posts on Zach’s Facebook account.
· She states they went under Birdsong bridge on multiple occasions.
· She states a TBI agent visited her at her mother’s residence after Zach had been arrested for this case and threatened to take her unborn baby and turn his in to DCS custody. She specifically stated that if she “didn’t tell the truth,” they would take her unborn baby away.
· She admits her statements have changed over time due to her being on drugs.
· Initially, she gave no indication Zach was involved, and confirmed Zach got scratches from being chased by an officer at the state park.
· Rebecca was also using meth and Xanax and marijuana at the time.
· She confirms the State Park incident happened the day after Zach’s grandmother’s funeral.
· She confirms Zach’s white pickup was not a full-size pickup truck.
· She confirms Zach had never made comments about Holly before the abduction.
· She admits Zach could have used the reward money.
· She states Zach had not attended the Coon Hunt that year.
· The TBI spoke to her again a few years after their final breakup. She states they were confident Zach committed the crime. They brought documents from Birdsong Auto Scrapping, including a list of people that had scrapped metal the day of Holly’s abduction. Zach’s name was not on that list, but the list left his name out on multiple other days that he had been scrapping as well.
· She states the day of the abduction, she arrived at work at 9 am.
· After they showed her this list, she admits she was angry at Zack, suspecting he was cheating on her since he had apparently lied to her about scrapping.
· She states Zach had three shallow scratches on the right side of his neck. She states she never questioned him about them because she was scared.
· She states she called the TBI after they found the remains of Holly Bobo.
· She states Zach had scratches on his arm before the abduction of Holly Bobo, and states he always was getting scratches.
· She states the TBI went over her call records for the day of Holly’s abduction with her.
· Jennifer Thompson states no texts or calls were sent from Dylan’s phone to hers that day, and she replies that Zach had a spoofing card that could make a text appear to be sent from any phone number he chose. She acknowledges this card would only change caller ID and phone call voice tones.
·· When asked by Jennifer Thompson if it would surprise her that there was no record of Dylan making any calls that day, including to the spoofing card number, Rebecca contradicts her previous testimony that Zach called her from Dylan’s phone on the day of the abduction, stating instead that all she remembers is that Zach called her from another phone number.
· She confirms that, the night before Holly’s abduction, her phone was hitting off her Mother’s cell phone tower from 10pm to 1am while she was calling Zach.
· She confirms she also said something to the TBI about Zach telling her he would tie her up in his closet, since they were in a closet at the time he said this – but denies saying Zach told her he would tie her up in his closet like he did Holly Bobo.
· She admits she wants to help the TBI convict Zach.
· She states she does not remember if Zach or John Mitchell said the substance in the blue Tupperware was Holly’s remains. She states she called the TBI afterwards with this information.
· Then, when they visited her on February the 28th, she did not mention the blue Tupperware incident again: “I didn’t think I had to mention it to him because I’ve already told them.”
· She then states she didn’t tell them on February the 28th because she was told it was a joke.
· She then states again that she didn’t feel like she had to repeat it since it was on record.
· She acknowledges she did not mention that she introduced Zach to Natalie Bobo to TBI when they first spoke.
· She acknowledges she was off drugs when her son was born.
· She states that, on the day of the abduction, she woke up around 8 am, got ready for work, went to the bank, ate at Sonic, then went to work.
· The State submitted a Motion to include 404-b domestic-violence related information.
· Rebecca is brought back to the witness stand without the jury present, and states the following information:
o She states that, the day she left Zach, they physically fought, she ran in the closet, and he held her down and tied her feet up with belts, before stating he was going to tie her up like Holly Bobo and no one would ever find her again.
o She states that, on the day of the abduction when Zach came to Joe’s Video, he grabbed her head as tight as he could and head-butted her.
· The jury is brought back in, and the Judge explains 404-b evidence.
· On the day of the abduction, she was picked up by her nephew and states Zach told her not to go to law enforcement or make any statements or “he would hurt [her] or [her] family.”
· She states that, the morning Zach told her he was scrapping on the day of the abduction, she heard his truck and trailer full of scrap pull around the house.
· That day, she states she left Zach a note asking him to move some laundry, and when she got home, the bottom part of the note was ripped off and the scrapyard’s old, dirty business card was taped on there. She found this suspicious because Zach told her he hadn’t been home all day.
· She kept the ripped note, and eventually gave it to TBI.
· She admits that she initially told law enforcement Zach was still home that day when she left for work at 9am, but states she was under the influence and “scared to death” due to the threats Zach had made to her.
· They remained friends after his arrest.
· Jennifer Thompson points out that, in her testimony, she originally stated she woke up from 6- 7:30 am, but on cross, stated she woke up from 6-7am.
· She changes her story that she thought Zach was cheating on her the day of Holly’s abduction, which she stated earlier in cross-examination.
· The trailer was not on Zach’s truck when he showed up at Joe’s video to see her.
